Well there's the Eiger Sanction, although it's a little murky whether Eastwood assassinated anyone vs natural causes. And I know when I first moved out here I read something about a murder or gunfight high on Longs Peak back in the 1800's - maybe I was delirious from the altitude because I can't find it on google.

Well there is always this, lifted from Wikipedia page on the Saichen conflict:

The Siachen Glacier is the highest battleground on earth,[14][15] where India and Pakistan have fought intermittently since 13 April 1984. Both countries maintain permanent military presence in the region at a height of over 6,000 metres (20,000 ft). More than 2000 people have died in this inhospitable terrain, mostly due to weather extremes and the natural hazards of mountain warfare.[citation needed]

I Say NOT.
This is straightforward. Yes, it's murder. Murder is simply the illegal and premeditated killing of a human.

There could be all sorts of justifications for why one should murder another, but it's still murder if it's illegal and premeditated. I often see the opposite happen when people talk about abortion or meat (killing animals). Neither can be murder because neither is illegal. Maybe they are immoral, but they cannot be murder.

I would just use common sense, which is much more appreciated in the Heartland than where I happen to live:
- Shooting missiles at manned unarmed aircraft - premeditated murder
- Columbia and crew of 7 disintegrating on reentry, most likely due to engineering negligence - accident
- "I'm sorry Dave, I'm afraid I can't do that." - fiction, same as Eiger Sanction, Vertical Limit or Die Hard. But we all like to indulge in it anyway.
